Estate Planning

Our experience is that Estate Planning is one of the most important yet commonly overlooked corner-stones in the financial planning process. Estates can be complex and the costs of not having an appropriate and comprehensive plan in place can be extremely high. Our role is to work with you to develop strategies for the preservation and distribution of your wealth in a way that is aligned with your wishes and implemented at the minimum possible cost.

We work with a small group of Estate Planning specialist solicitors who are engaged when appropriate to draft the legal documentation for you. We consult with them to ensure that your estate plan is implemented in full and matches your individual requirements.

  • A comprehensive estate plan may include:
    •  A Legal Will. This will ensure that the wishes of the testator are clearly documented for the executor and beneficiaries. The effect will be to reduce delays and minimise costly challenges during the wind up of an estate.
    • Powers of Attorney. This document formally appoints someone to look after the finances of another in the event of a ‘legal incapacity’. This may be through a loss of mental capacity, whether temporary or permanent.
    • Testamentary Trusts. This may be built into a Will document and lie dormant until the death of the testator. Testamentary trusts are a popular estate planning tool that can provide certainty and tax efficiency for a surviving family in the event of an early death.
    • Enduring Guardianship. An enduring guardian is a person who makes certain lifestyle and medical decisions on behalf of another in the event of total or partial incapacity. This can minimise the need of family members to resort to formal process in order to make these decisions.
    • Beneficiary Nominations. Given the growing superannuation balances and unlimited life cover that may be held within the superannuation tax shelter, having a formalised and appropriate beneficiary nomination is crucial. In certain circumstances, nominations can be made which effectively binds the trustee to your nomination, thereby providing peace of mind and certainty for the superannuant.
